About Sodomy of a Minor Charges in New York

Sodomy and oral copulation with a minor, or forced acts of this nature, are outlined in New York Penal Code Section 130.40, 130.45 and 130.50 and are designated "criminal sexual acts." Depending on the nature of the offense and the age of the victim, a person convicted of a criminal sexual act may face up to 4 years, 7 years or 25 years in prison.

Criminal Sexual Act of the First Degree - under this law, a person who engages in oral or anal sexual conduct with another person by force, against a child under 13, or against a victim who is unable to consent due to physical incapacitation, is considered guilty of a criminal sexual act in the first degree. This is classified as a Class B Felony, punishable by up to 25 years in prison. Enhanced penalties may be enforced if the victim sustains injury as a result of the act.
